What Happened to Posse Comitatus Act?

The Posse Comitatus Act was signed into law by President Rutherford Hayes. It prevents the military from conducting activities within the U.S. directed at U.S. citizens.
This, plus the NSA's spying, have extremely thin legal justification as far as I can tell. The full story on the surveillance is here. I would think the conservatives in D.C. would be up in arms about this. I'm disappointed they are not.
